1. Definitions
“Company” means UAB FULMENN, a private limited liability company incorporated under the laws of the Republic of Lithuania.
“Client” means any natural or legal person using the Company’s website or services.
“Services” mean route survey, route planning, road modification, permit coordination, civil escort, technical escort, and equipment rental services related to oversized and heavy transport.
“Oversized and Heavy Transport” means transport exceeding standard legal dimensions and/or weight limits.
2. Scope of Services
The Company provides professional services related to oversized and heavy transport, including but not limited to:
Route survey and route planning;
Road and infrastructure modification and adaptation;
Coordination and organization of transport permits;
Oversized vehicle civil escort services;
Technical escort and route preparation support;
Temporary rental of specialized equipment.
All Services are provided based on individual agreements, quotations, or written confirmations.
3. Geographic Scope
Physical escort and road modification services are provided in Lithuania, Latvia, and Estonia.
Route planning, route surveys, and permit coordination services may be provided throughout Europe.
The availability of Services depends on local regulations, infrastructure conditions, and authority approvals.
4. Website Use and Information
The Company’s website is for informational purposes only.
Submitting an inquiry through the website does not constitute a binding contract.
Contracts are concluded separately in writing via email or signed agreements.
5. Route Survey Disclaimer
Route surveys and related documentation are:
Based on visual inspections, measurements, available data, and professional experience;
Advisory and recommendatory in nature;
Not equivalent to official engineering expertise or authority approvals.
The Company does not guarantee that the proposed route will be approved by authorities or remain unchanged due to infrastructure, legal, or environmental factors.
6. Road Modification Services
Road modification and infrastructure adaptation services are performed:
According to pre-approved documentation and authority requirements;
As temporary or preparatory measures unless explicitly agreed otherwise.
Final decisions regarding infrastructure changes rest with road owners and public authorities. The Company is not responsible for delays or refusals caused by third parties.
7. Transport Permits
The Company acts as a coordinator and intermediary in obtaining permits.
Issuance of permits depends solely on competent authorities;
The Company does not guarantee permit approval or processing time;
Compliance with permit conditions is the sole responsibility of the carrier and/or Client.
8. Civil Escort Services
During escort operations:
The Company does not control the transported vehicle or cargo;
The driver remains fully responsible for vehicle operation and safety;
Escort services do not transfer liability for traffic incidents, damages, or violations.
9. Technical Escort Services
Technical escort services include temporary dismantling, protection of infrastructure, traffic management, and real-time coordination.
The Company is not liable for unforeseen infrastructure failures, third-party actions, or force majeure events.
10. Equipment Rental
Equipment is rented for temporary use only.
Risk passes to the Client upon handover;
The Client is responsible for proper use, damage, loss, or destruction;
Equipment must be returned in the condition received, excluding normal wear and tear.
11. Client Obligations
The Client must:
Provide accurate and complete transport data;
Ensure vehicle technical compliance;
Follow all applicable laws, permits, and safety requirements;
Cooperate with the Company during service execution.
12. Limitation of Liability
The Company shall not be liable for:
Cargo damage or loss;
Traffic accidents or violations;
Delays caused by authorities, weather, infrastructure, or third parties;
Indirect or consequential damages.
The Company’s total liability, if any, shall not exceed the value of the specific service provided.
13. Insurance
The Company maintains valid insurance coverage in accordance with applicable legal requirements and industry standards.
The existence of insurance coverage does not constitute an assumption of liability beyond the scope of the Services provided.
Insurance coverage applies only within the limits, terms, conditions, exclusions, and validity periods of the applicable insurance policies.
The Company does not provide cargo insurance and does not insure the transported goods unless expressly agreed in writing.
Any claims related to insured events shall be handled strictly in accordance with the insurer’s procedures.
14. Force Majeure
The Company is not liable for failure or delay caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, authority actions, or infrastructure failures.
15. Intellectual Property
All website content, documents, photos, videos, and materials are the intellectual property of the Company and may not be copied, distributed, or used without prior written consent.
16. Confidentiality
All non-public information exchanged between the parties shall be treated as confidential unless disclosure is required by law.
17. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Lithuania.
Any disputes shall be resolved exclusively in the courts of Lithuania.
18. Final Provisions
If any provision is deemed invalid, the remaining provisions shall remain in force.
The Company reserves the right to update these Terms and Conditions at any time.
